Terms of use

Octopusden is operated by the team behind the Octopusden agent at octopusden.app. For anything about these terms, email [email protected]. We answer within 30 days, and usually much sooner.

• We search Australian retailers for the product you are looking for and show what we call the True Final Price: our estimate of what you would actually pay, including delivery and any savings that apply.
• We are independent. We compare prices only. We do not sell, we do not take payment, we earn no commission, and we are not affiliated with or endorsed by the retailers we show. Nobody can pay us for a better position: the cheapest true price ranks first.
• If you buy something, your contract is with the retailer, not with us. Their terms, their delivery, their returns, their warranty. The same applies to a service provider you hire.
• When you leave Octopusden by clicking through to a retailer, you are on their site under their terms and their privacy policy.

Prices and availability change constantly, and a retailer can correct or withdraw an offer at any time. We take reasonable care to read each page correctly and we show you when we last checked, but we cannot guarantee that a price, a discount, a delivery cost or a stock level is right at the moment you buy.

Always confirm the final price with the retailer before you pay. If you spot something wrong on a page, tell us at [email protected] and we will look at it.

• Saved comparison pages are free to read without an account. Running a new search needs an account, because each new search costs us real money to run.
• You need to be at least 18 and to give accurate details. The account is yours alone: keep your sign-in secure and tell us if someone else is using it.
• There are daily limits on new searches, for you and for the site as a whole, so the service stays available and affordable. The limits can change.
• Please do not scrape the site, use bots, resell our data, try to get around the limits or the sign-in, or do anything that interferes with the service or with the retailers we contact.

Some features ask a retailer for a better price, or ask service providers for quotes. Nothing is ever sent without you pressing the button that asks for it. When you do:

• You authorise Octopusden to act as your agent for that request, and to send the message in your name. Every message says so and carries an authorisation reference, so the retailer knows who it is really from.
• Your name is in the message. When you ask us to collect quotes for a service, your email address is given to the providers as well, so they can reply to you directly.
• You confirm that what you tell us is true, including any competitor price you point to, and that you actually want what you are asking for.
• We do not guarantee that a retailer or a provider replies, or agrees, or offers a discount. Whether they honour anything is their decision, and any agreement you reach is between you and them.
• We keep a record of the request, the authorisation, and the replies, so both sides can see what was actually said. You can ask us to stop at any time.

If you set a price watch, we check that product for you and email you when the price moves the way you asked, and we may show a browser notification if you turn that on. Service emails about something you started, such as a reply from a retailer, are part of the service. You can stop watch and marketing emails at any time using the unsubscribe link in the email or in your settings.

Octopusden is an automated agent. It uses software, including artificial intelligence, to read retailer pages, work out the final price and draft the messages we send for you. We check its output and we build in safeguards, but automated systems make mistakes. If one affects you, tell us and we will correct it.

What we collect, why, who we share it with and how to have it corrected or deleted is set out in our privacy policy. We do not sell personal information.

Octopusden is free to use today. We can add, change, pause or withdraw features, and we can stop the service. We do not promise that it is always available or free of faults. If we ever introduce a charge for something, we will tell you first and you will never be charged for anything you have not agreed to.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded. Those rights come first.

Beyond that, and to the extent the law allows: Octopusden is provided as it is, our responsibility for the free service is limited to supplying it again, and we are not responsible for the acts of a retailer or a service provider, for the product or service you buy from them, for a price or an offer changing, or for a third-party website. You are responsible for any loss caused by your own unlawful use of Octopusden or by details you give us that are not true.

We can suspend or close an account that breaches these terms, abuses the service or the retailers we contact, or puts the service at risk. Where it is reasonable to do so, we will tell you why first and give you a chance to put it right. You can stop using Octopusden at any time and ask us to delete your account.

We may update these terms. The date at the top always shows the current version, and if a change materially affects you we will give you notice in the app or by email. Using Octopusden after a change means you accept the updated terms.

These terms are governed by the law of Australia. If we cannot sort a problem out between us, you can bring proceedings in the courts of the state or territory where you live.
